If you are having a issue no matter the size of the problem we want to handle it for you. The last thing we want is to bring on added additional stress to what should be a experience of a life time. All we want is to enhance your golfing experience. So if you feel that we have disappointed you enough that you would request a full refund for the portion of the tour you are unhappy about.

RESPONSIBILITY:

The responsibility of LegendaryGolfGetaways.com. and/or its agents are limited. LegendaryGolfGetaways.com. acts only as an agent for clients in regard to travel. LegendaryGolfGetaways.com assumes no liability for injury, damage, loss, accident, delay or irregularity which may be occasional either by reason of defect, through acts of nature, war, fire, breakdown in machinery, riots, strikes or from any causes beyond the control of LegendaryGolfGetaways.com. Tour services including tee times, transportation and lodging are furnished by independent contractors (suppliers) and do not act for or on behalf of FloridaGolfGetaways.com. The acceptance of tour arrangements is deemed to be consent to the above. LegendaryGolfGetaways.com is not liable or responsible in any way whatsoever for any act, error or omission or for inconvenience, loss, damage, injury or death arriving out of tour arrangements.

RESERVATIONS AND PAYMENTS:

An initial deposit of $200 per person is required to confirm a reservation. Final Payment is due 60 days prior to departure. For reservations made within 30 days of travel, full payment is required at time of booking.

LegendaryGolfGetaways.com cannot guarantee any reservations not paid on time. In some instances, LegendaryGolfGetaways.com is required to release rooms back to the supplier when not paid on time. In these instances, LegendaryGolfGetaways.com will make every effort to reacquire space. In this instance, the customer is required to pay any late booking fees incurred by LegendaryGolfGetaways.com plus a $25.00 re-booking fee.

CANCELLATION POLICY:

All cancellations must be received by LegendaryGolfGetaways.com. in writing.

Land portion of trip

The initial deposit of $200 per person is fully refundable if trip is cancelled within three days of making the reservation, provided the reservation was initially made 60 days prior to departure.   Reservations made within 60 days of travel are subject to the cancellation penalties outlined below. Cancellations received 31 or more days prior to departure will be assessed a per-person penalty of $100 plus any non-refundable fees assessed by the travel suppliers. Cancellations received between 15 and 30 days prior to departure will be assessed a per-person penalty of $150 plus any non-refundable fees assessed by the travel suppliers. Cancellations received 14 or fewer days prior to departure will be assessed a per person penalty of $200 plus any non-refundable fees assessed by the travel suppliers. 

CHANGES:

Changes made to existing reservations are subject to a $25.00 change fee any fees charged by the travel supplier.

GOLF:

All golfers must check in at least one half hour prior to tee time (an hour before would be ideal). Tee times missed due to late check in or due to weather related issues will be handled on an individual basis by each course and are not the responsibility of LegendaryGolfGetaways.com. Once play begins, no refunds will be provided by LegendaryGolfGetaways.com for any reason. No cash refunds will be issued for rain checks obtained at any golf course. Rain does not constitute cancellation of play unless golf course officially closes. LegendaryGolfGetaways.com. will not be responsible for lost or cancelled tee times as a result of air flight delays, war, or acts of God. All golf courses require proper attire (e.g. collared shirts, Bermuda shorts, no t-shirts, cutoffs or jeans, etc.).

NO REFUNDS FOR UNUSED SERVICES:

Refunds or allowances will not be made for transportation, accommodations, tee times, services or other portions of the trip which are unused on or after the tour departure date.

TRIP INSURANCE:

Passengers are strongly advised to protect themselves with insurance. Optional cancellation, accident, health and baggage insurance are available to protect tour participants from unforeseen circumstances. Upon request, LegendaryGolfGetaways.com. or your travel agent will provide further information and rates. Insurance must be purchased with initial deposit at time of reservation by the Insurance Company.

100% SATISFACTION GUARENTEE small print

LegendaryGolfGetaways.com has the right to change or terminate the conditions of the guarantee at any time without prior notice.  We will honor the terms of the guarantee as stated at the time of payment.

Payment of the Golf vacation must be made in a timely fashion based on the terms and conditions of payment to acquire our guarantee.  If payment is not made in a timely fashion then the guarantee is void.

The LegendaryGolfGetaways.com Golf Vacations Guarantee is implicit on client’s agreement to the vacation’s “terms and conditions.”

In order to qualify for our guarantee, you must contact and inform our Customer Service Department via telephone or e-mail within 24 hours of the situation occurring otherwise the guarantee will not be applied.

The reservations are deemed confirmed when you receive the confirmation e-mail from your sales representative 48-72 hours after reserving your vacation.  The Guarantee is applicable from this point onwards.

General Exclusions:

We promise to never mark up prices above the listed rates of hotels and tour providers, except for force majeure (national economic crisis).

Basically, as you will agree too, that we can on offer a 100% total Satisfaction Guarantee on items and programs that we are in total and complete control of. For example, if a hotel housekeeping person would accidently forget to pick up a wet towel off your bed, yes, you would maybe be upset, but we at LegendaryGolfGetaways.com could of never anticipated that action. As you could easily understand.

Also, LegendaryGolfGetaways.com cannot be held liable for situations that are not under our control.  This includes but is not limited to: inclement weather conditions, flight delays, lost luggage, missed transfers, National Authorities regulations, activities in public areas, etc.

The Guarantee is not applicable between the time of booking and the confirmation e-mail being sent to you with all the confirmation details on.

Specific Exclusions:

Photos on our website are the most recent representation of each property provided to us by our Partners. The rooms and property may look different due to regular wear and tear, weather conditions or recent renovations.

The guarantee does not apply in the case of the closure of any hotels, rentals or tour agencies after the time of booking.

LegendaryGolfGetaways.com cannot guarantee that hotels will provide all services listed that vary based on hotel occupancy and operation policies. This includes bed type, free shuttle services and access to all hotel facilities.

The estimated travel time that is provided in your itinerary may vary according to stops made in route to your destination, road conditions, heavy traffic due to high season, group size and/or special needs of passengers.

If between the time of booking and the itinerary being confirmed something on the itinerary changes due to availability this does not fall under the terms of guarantee.

SCOTLAND/IRELAND TERMS & CONDITIONS  

DEFINITIONS

In these Terms and Conditions, the following words shall have the meaning set opposite: – “Conditions” means these Terms and Conditions; “Deposit” means 50% (whichever is the greater) of the price per person. “Itinerary” means a personalized schedule produced by Us for You, containing a Package based on Your requirements; “Package” means the pre-arranged combination of at least two of the following components when sold or offered for sale at an inclusive price and which service covers a period of more than 24 hours or includes overnight accommodation:- (a) transport; (b) accommodation; (c) other tourist services not ancillary to transport or accommodation and accounting for a significant proportion of the Package; “Personal Information” means information provided by You on creating an Itinerary or making a Reservation to include Your name, address, contact details and payment details; “Price” means the total price paid per person for the Itinerary; “Reservation” means the securing of the Itinerary, when the Deposit has been paid within 5 days of receiving your finalized Itinerary; “Service Provider” means any other party other than Us, who will provide services for the Itinerary including, but not limited to accommodation, transport and golf passes; “Start Date” means the date upon which the Itinerary commences; “We/Us/Our” means Links LegendaryGolfGetaways.com our company name and address. “You/Your” means the person(s) making the reservation. 

YOUR ITINERARY 

Your Itinerary will contain details of the following…your travel destination and/or destinations together with details of dates and relevant periods of stay, the location of accommodation; its tourist category or degree of comfort; it’s main features and the accommodation’s compliance with the rules of the United Kingdom, if appropriate. Please note that if the accommodation is in any other member state of the European Community (Ireland), the Itinerary will state that the accommodation will comply with the compliance rules of that particular member state. All quotations are made based on rooms with private bath/shower at the hotels requested. Once your reservation is made, and any accommodation in the Itinerary shown as subject to availability before the reservation is made has been confirmed, no changes will be made without consultation and agreement with us. Upgraded rooms are available for a supplementary charge in most hotels (subject to availability), details of any meals, minimum number of persons required for the Itinerary to take place, details of any visits, excursions or other services which are included in the price, our contact details and the details of any Service Provider, the price together with the payment schedule, details of any special requirements which you have expressed to us and which have been accepted by us and the relevant Service Provider, visa and Passport Information which apply to nationals of the European Community, including information about the length of time it is likely to take to obtain the appropriate passports and visas. We shall also endeavor to include any Visa and Passport information for nationals out with the European Community, health Information, where applicable to UK residents making a reservation, security arrangements for the security for the money paid over (and where applicable) for repatriation of you in the event of insolvency. 

PAYMENT AND AMENDMENT 

Full payment of the Itinerary is due at least 60 days before the start date. Golf course fees and prepayments, along with certain other deposits are non-refundable at any time. (refer to the Cancellation section below)


PRICE 

NOTE: as of to date we have never raised rates once you booked. We will endeavor to keep the price as detailed on your Itinerary at the time of Reservation, however the price is subject to change (whether increase or decrease) due to variations in the following…transport costs, including fuel costs, dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports; and/or applicable exchange rates. Price increases will be made only up to 30 days before the start date.  No Price increase will be made in respect of variations which result in an increase less than 2% of the price. 

CANCELLATIONS 

By you…notification of cancellation must be forwarded in writing to us as soon as possible at the address noted above. Cancellation fees will be charged to you to cover non-refundable charges incurred by us in making your reservation, including administrative costs. 

Cancellation fees are as follows. Cancellations for groups of 8 or less-

  • More than 60 days before arrival- Loss of deposit

  • Between 59 days and 30 days before arrival – 60% of tour price including deposit

  • Between 29 and 15 days before arrival – 80% of tour price including deposit

  • Less than 15 days before arrival 100% – of tour price including deposit

The Deposit shall be refunded by us, and any cancellation fees hereunder shall be reduced in full, in the event of cancellation as a result of our material breach of these Conditions, or in part (after the deduction of Our expenses) solely to the extent that the event is resold by us, in the event of cancellation for any other reason. 

Prior to Start Date, if we cancel the Itinerary, we will endeavor where possible to provide an alternative Itinerary of equivalent or superior quality; or provide an alternative Itinerary of lower quality and pay you the difference between your Itinerary and the substitute Itinerary. Failing which, you will be entitled to a full refund. 

Where We fail to provide the Itinerary, You are entitled to cancel and be refunded any price paid except where the number of persons who agree to attend the Itinerary is less than the minimum number required and where you are informed of the cancellation, in writing at least 60 days prior to the Start Date where the Itinerary is cancelled by reason of Force Majeure. 

Where it becomes apparent after Start Date that a significant proportion of the Itinerary contracted for is not or cannot be provided, We will make suitable alternative arrangements, at no extra cost to you, for the continuation of the Itinerary and will, where appropriate, compensate you for the difference between the Itinerary to be supplied under the reservation and those supplied. In the event that it is impossible to make such arrangements or if you do not accept the alternative arrangements for good reasons, we will, where appropriate, provide you with equivalent transport back to the place where the itinerary began or to another place to which you have agreed and will, where appropriate, compensate you. 

Initial Deposit

In order to proceed with your arrangements, an initial deposit is due upon acceptance of our proposal. The amount of your initial deposit is stated in your proposal.

The initial deposit is refundable if we are unable to reserve tee times on one (or more) of the courses in your itinerary. Second Deposit

A second deposit is due from all group members once all reservations are confirmed. Payment of this second deposit represents your endorsement of the accommodations and tee times as presented to you and, as such, is non-refundable under any circumstance.

Final Balance Payment

The final payment will be due 60 days prior to departure. However, if a guaranteed / specific Old Course tee time has been obtained other than through the advance application process, the remaining balance will be due 95 days prior to departure.

CHANGES

After the second deposits have been paid, changes to your group’s itinerary will be assessed a fee of $50.00 per change per person.  No changes will be made within 60 days of departure. These administrative fees are in addition to any supplier charges incurred as a result of such changes. Changes may also result in the forfeiture of non-refundable deposits and/or prepayments paid to golf courses or hotels. We reserve the right to charge payment (due as a result of any change) to the group leader as a lump sum (i.e., individual invoices will not be sent). Amendments that increase the number of participants will not incur a change fee.

TRANSFER OF BOOKINGS 

Where you are prevented from proceeding with the package, You may transfer the package to another person (“transferee”) who satisfies all the conditions applicable to the package, subject to You providing reasonable notice to Us prior to the commencement of the package. Please note that you and the transferee shall be jointly and severally liable to us for payment of the balance price and for any additional costs arising from such transfer. 


PACKAGE DOCUMENTS 
Approximately 3 weeks prior to the Start date you will receive Your personalized information pack containing all relevant documentation. This will include details about the transport provided (including times and places of immediate stops and transport connections if relevant); and accommodation e.g Sea view room at St Andrews Hotel. The information pack will also include the name, address and telephone number of Our representative in the area of Your stay. Also, if a child under 16 is traveling unaccompanied without parent/guardian, information will be provided so that direct contact may be made with the child or the person responsible at the place where the child is to stay. 


UNUSED TOUR SERVICES 

Partly used or unused services included in the Itinerary, are non-refundable except as stated otherwise. No refunds will be made for any hotel accommodation, meals, golf, entry tickets, nor any other service not used due to flight delays, schedule changes or for any other reason, other than those stated in these Conditions. 

CHANGE OF ESSENTIAL TERMS 
Where we must alter significantly an essential Term of the Conditions, we will inform you of this change as soon as possible to allow you to take an appropriate decision; to include withdrawing from the Conditions without penalty or allowing us to amend the Conditions. Any amendment by us will specify the changes made and how these have impacted on the price. You must inform us of your decision in this matter within 5 working days. 


GOLF HANDICAP CERTIFICATE 

If you are participating in golf you must carry a current “Handicap Certificate” and a general Letter of Introduction from your home club, unless waivered by prior arrangement with us. Golf play can be denied on failure to produce this to the starter at many British golf courses. Your Itinerary will detail the Handicap limit applicable to you for play during your tour (based on the course with the lowest Handicap requirement). 

HOTELS

Our price assumes double occupancy (unless otherwise stated in the proposal) and is based on the number of participants stated in the proposal. All prices are based on standard rooms with private bathrooms at the hotels or guesthouses suggested in our proposal, unless otherwise specified. Superior or deluxe rooms, suites, or rooms with views (sea or golf course) are available at many hotels for an additional charge. Should you require an upgrade in accommodations, please state the request in writing upon payment of your initial deposit. Most hotels and guesthouses have only a limited number of single rooms to which a separate price applies. Should rooms be unavailable, accommodations at a comparable establishment will be offered, with any necessary price adjustment. Room rates vary depending on the month of travel and, quite often, on whether the reservations are for a weeknight or weekend night.

Most direct trans-Atlantic flights arrive in the UK or Ireland in the morning. Hotel and guesthouse rooms are often not available on arrival since the official check-in time is typically between 1:00pm and 3:00pm. However, luggage and clubs usually may be left at the hotel or guesthouse prior to check-in.

CADDIES

LegendaryGolfGetaways.com will request caddies for all group participants several months in advance of the departure date. However, caddies are independent contractors, not employees of the club, and, as such, their services cannot be guaranteed. Furthermore, golfers are directly responsible for compensating (in local currency) any caddie that has been requested on their behalf. Cancellation of the services of a caddie must be in writing, and if not received 72 hours in advance of the round, will be payable nonetheless.


TRAVEL INSURANCE 

We strongly recommend any persons wishing to travel, to arrange Travel Insurance independently. A number of other companies offering good cover can also be found on the Internet. It is common practice for insurance providers to only accept applications within a few days of making a reservation and paying the deposit for a schedule. It is therefore recommended that insurance should be taken early in the booking process. 


LIABILITY 

We are liable to you for the proper performance of the obligations contained in the Itinerary, and Conditions irrespective of whether such obligations are to be performed by us or another Service Provider. However, this shall not affect any remedy or right of action which we have against those Service Providers. 

We are liable to you for any damage caused to you by the failure to perform or improper performance of any of our obligations under the Itinerary or Conditions except where failure or improper performance is attributable to (a) You; (b) a third party unconnected with the Itinerary, which are unforeseeable or unavoidable; or (c) unusual and unforeseeable circumstances being beyond our control, the consequence of which could not have been avoided, foreseen or forestalled, even if all due care had been exercised.  Any liability arising from the non-performance or improper performance of the Itinerary and/or Conditions, except that of Personal Injury or Death, will be limited to $1,000,000. 

In the event, you feel that any of the package is not being supplied in accordance with the Itinerary or Conditions you must, at your earliest opportunity, communicate this failure in writing to us at the above address. 

FORCE MAJEURE 

We will not, together with our Service Providers, be liable for injury, damage, loss, accident, delay, irregularity, changes or inconvenience caused by, but not limited to, the following: any force majeure health risks, reasons of war, threat of war, riots, civil strife, terrorist activity, or expense to personal property due to act or default of any hotel, carrier or any other company or person providing or rendering of the Itinerary. 

We will not, together with the Service Providers, accept responsibility for any sickness, pilferage, labor disputes, machinery breakdown, government restraints, weather condition, defect in any vehicle or transportation or for any misadventure or casualty or any other causes beyond our control. 


METHOD OF PAYMENT 

Payment of the Deposit and final payment can be made either by Visa, MasterCard, American Express and Discover.

DATA PROTECTION / PRIVACY

You shall consent and shall procure the parties on whose behalf you are making the reservation, consent to his/her details being used for the purpose of the Itinerary. We may use the main address of you in relation to the Itinerary and the organization of the Itinerary.

We undertake that we will not disclose any Personal Information belonging to you without your prior written consent. We will hold all information about you securely, in accordance with our internal security policy and with UNITED STATES law. We will hold information about your transactions with us for administrative and legal reasons, and will not disclose such information to any third party except as expressly set out hereunder or as required by UNITED STATES law, or for the purposes of UNITED STATES statutory audit. 

We will hold Personal Information about you, including your name, address, phone number, email address, details of packages you have bought, transaction information (the numbers, amounts and times of payment you have made to us), and billing address details. 

We confirm that any Personal Information which you provide to us shall be used to organize and arrange the Itinerary in accordance with your instructions.

You shall allow us to obtain information about you from third parties from time to time including but not limited to your debit or credit card number or credit reports to authenticate Your identity, to validate Your debit or credit card, to obtain debit or credit card authorization and to authorize transactions. This information will not be made available to third parties for credit assessment purposes. 


ASSIGNATION

These Conditions shall be binding upon the parties and shall not be capable of novation, assignation or other transfer by you without the prior written consent from us, which consent should not be unreasonably conditioned, withheld or delayed; provided that in all cases of assignation the assignee effectively undertakes to perform all the obligations of the assignor as though the assignee had been an original party hereto. 


GOVERNING LAW

These Conditions shall be governed by and construed in accordance with the law of United States of America in Naples, Florida. Each party irrevocably agree to submit to the exclusive jurisdiction of the courts over any claim or matter arising under or in connection with these Conditions or the legal relationship established by these Conditions. 

OLD COURSE TEE TIMES

The following Terms and Conditions apply to golfers playing The St Andrews Old Course.

All golfers must check in with the official starter of the relevant course thirty minutes before the allocated tee-off time. Failure to appear at the precise tee-off time shall render the client’s right null and void. 

In order to play on the Old Course, clients require a valid handicap certificate in line with St Andrews Links Trust policy and must adhere to St Andrews Links Trust’s pace of play policy. 

Golfers’ names must be applied to Old Course tee times and notified not less than 30 days prior to play. On the day of play golfers’ names must match those previously notified, otherwise golfers will be refused permission to play. 

The tee times in any programs sold are subject to any terms, conditions and limitations of liability imposed by St Andrews Links Trust and other relevant clubs or their agents and these respective terms are hereby incorporated into our terms with you. You acknowledge that you have no contract other than with Authorized Provider in connection with the programs sold.
